A photo of Justin Bieber wearing a backpack and engaging in a game of beer pong has landed online.

But before all ye haters start ripping into the Biebs -- who is 18 and not the legal drinking age in the U.S. -- there are mitigating circumstances.

We'd like to point out that he does not have a drink in hand nor is he actively ponging. He is watching. Perhaps he is participating. But this photographic evidence is inconclusive.

Also, exactly when and where this photo was snapped is decidedly unclear. Sources say that this game of beer pong took place in either the singer's native Canada, where the drinking age is 18 or 19 depending on the province, or in Georgia.

The source also claims this photo was taken a year-and-a-half ago, so the Biebs would be too young to booze it up regardless (plus the drinking age in Canada is 19).

A different source says this photo was taken in Alabama this summer. So now that we're clear on that…

…TMZ reports that the 'As Long as You Love Me' singer did pound some brews while playing, although there are no photos of such activity, so we will give JB the benefit of the doubt.

He does look like your average college kid -- backpack, baseball cap -- playing a drinking game. Again, we can't slap the singer on the wrist since we don't see him actually guzzling brewskis.
