When word spread that Hilary Duff and her ex-husband Mike Comrie were getting a divorce, reports were sure to mention that the split was an amicable one. But it looks like things might not stay that way, depending on how their battle for custody over their three-year-old son Luca goes.

According to E! News, Comrie filed his divorce papers on April 16 and is asking for joint legal and physical custody of Luca. While this does not seem like an odd request, Hilary initially filed for sole custody of Luca, leaving Comrie solely with visitation rights.

Hilary and Comrie first announced their separation back in January 2014, after three years of marriage. And while some claim the two are simply better off as friends, other sources say Hilary filed for divorced because of excessive partying on Comrie's part. Hilary recently opened up about the split during an interview with Cosmopolitan, saying, "Mike and I were very in love when we met. We both really wanted to get married. I’d been working since the age of 11 or 12, so making that choice at a young age seemed right for me. Maybe it wasn’t, but we spent the majority of our time together really happy. It wasn’t working well enough to stay together, but there was still a lot of love involved. It was just a slow set-in of us not being the match that we used to be. I’m lucky for the person he is and I am, and how we decided to handle this."
